The 65th year of a scholar who has devoted 40 years to editing and elucidating Robert Grosseteste provides us with a collection of essays. Not surprisingly, they emanate from colleagues and former students of Richard Dales and reflect his interest, among other concerns, in Grosseteste's aspectus et affectus - range of vision and disposition of mind - those twin peaks with which the 13th century thinker helped to get Christian thought through Aristotle without mutual destruction.

Richard Jeffrey is beyond dispute one of the most distinguished and influential philosophers working in the field of decision theory and the theory of knowledge. His work is distinctive in showing the interplay of epistemological concerns with probability and utility theory. Not only has he made use of standard probabilistic and decision theoretic tools to clarify concepts of evidential support and informed choice, he has also proposed significant modifications of the standard Bayesian position in order that it provide a (...) better fit with actual human experience. Probability logic is viewed not as a source of judgment but as a framework for explaining the implications of probabilistic judgments and their mutual compatability. This collection of essays spans a period of some 35 years and includes what have become some of the classic works in the literature. This paper examines the lawsuits brought by state and local government entities against prescription opioid producers and sellers. It examines their potential liability as well as some of the defenses they might raise. The paper also discusses multidistrict litigation and government lawsuits in state court. It concludes that litigation is not the best solution to the opioid crisis.

In his seminal 1935 study of the internal senses in medieval2 thought, Harry Austryn Wolfson presented a detailed account of the development of the "classification and terminology" of the Greek, Arabic, Hebrew and Latin traditions on sensory powers which he called, "post-sensationary faculties,"~ that is, powers which are posterior to the five external senses. In explaining the complex development of teachings on the internal senses from Aristotle's texts, Wolfson recounted the Aristotelian understanding of Galen who specifically locates the OHXVOTl'ttKOV or (...) cogitative faculty in the middle ventricle of the brain and John of Damascus whose equally Aristotelian account follows the Stagirite in attributing judgments of goodand bad as well as combination and separation of ideas to the omvoTl'ttKTJ 'lfUXTt or the cogitative soul and to ouxvma or cogitation.4 One of the many fruits of Wolfson's discussion was an explanation of the development of the Avicennian doctrine of estimation as arising"out of a desire to supplement a deficiency which seemed to exist in Aristotle's account of the actual motion of pursuit and avoidance which is observed in both man and animal. "5 With wahm used to describe instinctive behavior consequent upon non-rational animal imagination analogous to human reasoning or deliberation, Wolfson wrote, the Arabic fikr now was tobe associated with imagination and no longer was to be seen as simply the power of combining and separating ideas. "In the case of ouivotcx combined with imagination, it is the combination and separation of images, i.e., the construction out of images of things existent, new composite images of things nonexistent, or the breaking up of images of things existent into images of things nonexistent."6 From this moment on, and not without some foundation in Aristotle's own texts as indicated, fikr/ cogitatio and their related derivative terms are used to characterize human rational powers which are essentially activities involving the bodyand bodily instruments insofar as imagination is necessarily bodily. In terminally ill individuals who would otherwise end their own lives, active voluntary euthanasia (AVE) can be seen as life-extending rather than life-shortening. Accordingly, AVE supports key pro-euthanasia arguments (appeals to autonomy and beneficence) and meets certain sanctity of life objections. This paper examines the extent to which a terminally ill individual’s wish to donate organs after death contributes to those life-extension arguments. It finds that, in a terminally ill individual who wishes to avoid experiencing life he considers to be (...) not worth living, and who also wishes to donate organs after death, AVE maximizes the likelihood that such donations will occur. The paper finds that the wish to donate organs strengthens the appeals to autonomy and beneficence, and fortifies the meeting of certain sanctity of life objections, achieved by life-extension arguments, and also generates appeals to justice that form novel life-extension arguments in favour of AVE in this context. This paper makes the case for using the independent non-executive directors of a company listed in the United Kingdom exclusively as monitors and regulators of management, particularly as regulators of executive directors’ conflicts of interest, rather than as participants in management who also have a control function. It is suggested that these proposals can be accommodated within current corporate law in the United Kingdom, that they are practicable, and that they are desirable. The proposals are made against the background of (...) a continued strong emphasis in the United Kingdom on non-executive directors’ dual role both as managers of a company’s business and as monitors of its executive directors. It is suggested that this dual role for non-executive directors tends significantly to undermine the effectiveness of their control function, and that consequently the dual role should be abandoned in favor of the more focused role proposed in the paper. Improving the effectiveness of non-executive directors as regulators of executive directors’ conflicts of interest is vitally important to corporate governance in the United Kingdom: as the paper explains, other legal methods of controlling those conflicts in the United Kingdom suffer from serious deficiencies. Shareholders are sometimes considered to be, in moral terms, the owners of a company, they are after all the carriers of the residual liabilities and bear a higher proportion of the financial risk. However, in company law, the shareholders’ responsibility is limited, and in financial terms shareholders are only liable up to the fully paid value of the share certificate. Moreover, when the shares are sold, the responsibility and risk are transferred completely to the new bearer of the shares. Whether (...) this gap in moral and legal perceptions can be judged to be satisfactory in business ethics terms is a moot point and will be partly explored in this case study which seeks to analyse the shareholder’s responsibility towards a firm in which they own shares. The case study company chosen as a vehicle to explore these issues is that of Turner & Newall; a company that subjected its employees, communities and customers to a major health hazard – asbestosis. This paper will use the Turner & Newall archive materials to illustrate the moral hazards that can arise for shareholders. In particular it will examine the ethical responsibilities of shareholders towards those stakeholders who were exposed to the dangers of asbestos. This case is a significant test of the veracity of the legal system of company control, and exposes the ineffectiveness of that system in accountability terms. The case study also deals with specific issues that arose in the asbestos crisis, as well as with more general issues in our present system of corporate governance and shareholder responsibilities. Observers of metropolitan dysfunction have long advocated for a regional tier of government that could (among other things) equalize spending across local jurisdictions, pursue cooperative economic development policies, provide for fair share housing, rationalize land use, and coordinate transportation planning. For many good government reformers, right-scaling our fragmented metropolitan areas appears to be an obvious solution to interjurisdictional spillovers and competitive races-to-the-bottom. This article counsels caution. “Region hope”—the idea that the substantive problems of metropolitan governance can be solved regionally by (...) redrawing territorial boundaries to encompass ever-larger areas—is perennial. But territorial manipulation in aid of state centralization has significant drawbacks. The regional impulse exhibits some key features of failed social engineering efforts; seen through the lens of the state, these efforts privilege technocratic over democratic governance, bureaucratic over local knowledge, and mobile over immobile capital. That does not mean that regionalism should be resisted in all cases, but only that the costs of territorial manipulation should be weighed against its asserted benefits. (shrink)

Two of the most influential arguments in favour of the permissibility of abortion were put forward in the latter half of the twentieth century by Judith Jarvis Thomson and Mary Anne Warren. The implications of these arguments for unwilling putative fathers have largely not been considered. Some have argued that Thomson's defence of abortion might allow a man under certain circumstances to terminate his parental responsibilities and rights. To my knowledge, nobody has considered the implications of Warren's argument for men. (...) I will consider the implications of both arguments for men. I will argue that if they are successful defences of abortion then they are also successful in justifying a male counterpart to abortion which I label ‘elective abandonment’. I will not be defending or attacking these arguments as defences of abortion, but will defend the claim that they apply as well to elective abandonment as they do to abortion. (shrink)

The philosophical problem of the relation of symbol to truth is far from solved, but there have been significant advances toward its solution. It is the common Christian understanding that God is Truth , and that all truths must ultimately find union in him. This is to say that all genuine truths must be compatible. The true conclusions of genuine science must be compatible with the true conclusions of genuine theology. Or, to bring this general statement to a more particular (...) level, the true conclusions of Biblical scholarship must be compatible with the true conclusions of the natural sciences. When this compatibility is lacking, and it so often is, we must assume that the conclusions of one field of truth-seeking or the other do not partake of the Truth which is God. And there is no guarantee that theology as a field of truth-seeking cannot err. Another characteristic of genuine truth is that it is not dependent upon any particular environment or milieu —either social, cultural, philosophical, or even theological. Unless we are to make the common but dangerous division of sacred and secular, of holy and profane, claim that these areas of human experience have nothing to do the one with the other, compartmentalise our thought, and ask, ‘What has Athens to do with Jerusalem?’, it must be concluded that there is no one specifically Christian milieu . Genuine truths must be true at all times, in all places, and for all men. But since we are not gods, we must hold these truths in what St Paul called earthen vessels , vessels shaped and moulded by our particular milieu. (shrink)
